1.WAIVER OF CLAIMS AND ASSUMPTION OF RISK
The Host acknowledges and agrees that Hibachi AZ, its agents, employees, or representatives assumes no responsibility for the safety of, or any damage to, any property at the Event location. IN CONSIDERATION FOR THE SERVICES PROVIDED, THE HOST, FOR THEMSELVES AND THEIR GUESTS (ON WHOSE BEHALF THEY HEREBY ACT AS AUTHORIZED AGENT), VOLUNTARILY AND KNOWINGLY ASSUMES ALL RISK OF PROPERTY DAMAGE AND HEREBY UNCONDITIONALLY WAIVES, RELEASES, AND FOREVER DISCHARGES HIBACHIAZ FROM ANY AND ALL CLAIMS, KNOWN AND UNKNOWN, FOR PROPERTY LOSS, DAMAGE, OR DESTRUCTION, WHETHER OCCURRING PRIOR TO, DURING, OR SUBSEQUENT TO THE EVENT, REGARDLESS OF CAUSE.
2. Safety Warning & Liability Exclusion
For the safety of all persons present, the Licensee (Host) and their guests shall maintain a safe distance from the grill and all cooking equipment at all times during the Event. HIBACHI AZ SHALL NOT BE HELD LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM GUESTS TOUCHING, MOVING, OR OTHERWISE INTERFERING WITH THE EQUIPMENT, OPEN FLAMES, OR THE COOKING PROCESS.
3. Venue Requirements & Compliance
HIBACHI AZ services are for OUTDOOR USE ONLY. An acceptable outdoor area includes, but is not limited to, a backyard, patio, or driveway that is clear of overhead obstructions and flammable materials. INDOOR COOKING IS STRICTLY PROHIBITED unless HIBACHI AZ has received prior written authorization from the property owner or authorized agent. The Licensee (Host) assumes full and sole responsibility for any fines, penalties, damages, or claims (including from rental platforms or landlords) arising from a violation of this outdoor-use provision.
